Terms of Service & Refund Policy

This document governs your use of our car-deal negotiation services. Please read it carefully.

1. Overview and Definitions

  • Business Hours means Monday–Saturday, 9:00 a.m. to 6:00 p.m. Eastern Time, excluding federal holidays.
  • Client means the individual or business requesting our services.
  • Services means car‑deal negotiation and related concierge support delivered remotely. We are not a dealer or broker and do not sell vehicles.
  • Standard Service fee: $499. Specialty Service fee: $799.
  • Qualifying Offer means a written dealer quote for the approved configuration that meets your confirmed budget cap or better, excluding government fees and taxes.
  • Buyer’s Order means a dealer‑issued buyer’s order, purchase order, or equivalent binding offer itemizing vehicle, price, and required fees.
  • Out‑the‑Door (OTD) price means vehicle price plus lawful dealer fees, taxes, tag, title, and registration, minus applicable incentives. If we do not explicitly agree to an OTD cap in writing, caps are interpreted as selling‑price caps.
  • Good‑Faith Target means your written budget cap that is commercially reasonable given MSRP, current incentives, inventory, and local market conditions. It is a target for negotiation, not a guarantee.

2. What We Do

We contact dealers, request quotes, and negotiate price and terms aligned with your preferences and budget cap. Financing, sales contracts, title, and delivery occur on dealer or lender portals.

3. Not Legal, Tax, or Financial Advice

We provide negotiation assistance only and do not give legal, tax, or financial advice. By using our site or services, you agree to these Terms and consent to transact business electronically.

Acceptance; Electronic Records & Signatures

You authorize Concierge My Car LLC to communicate with dealers on your behalf for the limited purpose of obtaining price quotes and terms consistent with your targets.

4. Your Responsibilities

  • Provide accurate information and required documents promptly.
  • Define a commercially reasonable budget cap and vehicle targets.
  • Be reachable during business hours for decisions.

5. Price Targets, OTD & Add-Ons

Our goal is the lowest out‑the‑door (OTD) price reasonably attainable. If a stated target is materially below market pricing, we will request a revised cap before the Guarantee clock starts.

6. Fees and Payment

Fees are due upfront via our payment processor (e.g., Stripe). Current fees are $499 for Standard Service and $799 for Specialty Service. You agree not to initiate chargebacks for services rendered as per this agreement.

7. 72‑Hour Deal Guarantee (Summary)

This guarantee applies only to Standard Service. If we fail to obtain a Qualifying Offer within 72 business hours after the clock starts, you are eligible for a refund per our Refund Policy. Delivering a valid Buyer’s Order that meets your terms satisfies the Guarantee.

8. Third‑Party Relationships

Dealers, lenders, and shippers are independent third parties. We are not responsible for their actions. We act as an independent contractor, not your legal agent or fiduciary.

Dealer Incentives & Kickbacks

We do not solicit or accept dealer referral fees or incentives (i.e., dealer kickbacks). Our sole responsibility is to represent your interests throughout the negotiation process, ensuring that all advice and actions are made entirely in your best interest.

9. Confidentiality and Privacy

Your information is used solely to perform the Services. Please review our full Privacy Policy.

10. Intellectual Property

All site content and materials are owned by Concierge My Car LLC.

11. Prohibited Uses

Do not use the Services for any unlawful purpose, to defraud, or for competitive intelligence.

12. Termination

We may decline or terminate a request for any lawful reason. Refunds, if applicable, will follow the Refund Policy.

13. Disclaimers

Services are provided on a best-efforts basis. We do not guarantee a specific vehicle, financing approval, or other outcomes controlled by third parties.

14. Limitation of Liability

To the fullest extent permitted by law, our total liability is limited to the fees you paid to us for the Services in the preceding six (6) months.

15. Indemnification

You agree to indemnify Concierge My Car LLC from any claims arising from your breach of these Terms.

16. Governing Law and Dispute Resolution

These terms are governed by Florida law. Except for small-claims matters, any dispute will be resolved by final and binding arbitration in Brevard County, Florida, on an individual basis. You waive any right to a class action or jury trial.

You may opt out of arbitration within 30 days of accepting these Terms by emailing us.

17. Changes to Terms

We may update these Terms by posting a new version with an updated effective date.

Refund Policy

Effective date:

1. 72‑Hour Deal Guarantee (Standard Service)

Eligibility for Full Refund ($499):

  1. Clock Start: The 72-hour countdown begins only after we have received (a) your full payment, (b) all necessary documents, and (c) your confirmation of a commercially reasonable budget cap (a "Good-Faith Target").
  2. Success Condition: We secure at least one written "Qualifying Offer" or a final "Buyer’s Order" from a dealer that meets your approved terms within the 72-hour window.
  3. Guarantee Failure: If we fail to meet the Success Condition within 72 business hours, you are entitled to a full refund of the $499 fee upon request.

Exclusions from Guarantee:

  • Specialty Service ($799) is not covered by the time guarantee.
  • Delays caused by your unresponsiveness (6+ business hours).
  • Changes you make to the vehicle target or budget mid-process (resets the clock).
  • Unrealistic budget caps that are not adjusted upon our request.

2. Cancellations and Other Refunds

  • Before work begins: Full refund.
  • After work begins but before a Qualifying Offer: Partial refund may be offered at our discretion, based on work performed.
  • After a Qualifying Offer is delivered: Fees are non-refundable as the core service has been rendered.

3. How to Request a Refund

To request a refund, please email support@conciergemycar.com with your name, order date, and a brief reason for the request.

Concierge My Car LLC acts solely as a negotiation and advisory service. We do not buy, sell, or broker vehicles. All transactions occur directly between the client and the licensed dealership.
